The RAP Trap: Six Ukrainians Detained in India’s High-Security Custody

After six Ukrainians were arrested by the NIA, the Northeast region of India has emerged as a hotspot for a complicated diplomatic and security situation. These individuals were arrested at major transportation hubs throughout India and are suspected of having entered Mizoram illegally and have also likely entered through an illegal crossing into Myanmar. A seventh suspect, an American named Matthew VanDyke, was also arrested while trying to depart from the Kolkata airport in relation to the same investigation.

Charges and Legal Proceedings

There have been multiple allegations made by Indian authorities against the group related to breaches of the Foreigners Act and the Unlawful Activities (Prevention) Act (UAPA) of India. On 16 March, the New Delhi Court heard the claims and extended the detention period of the six Ukrainians until 27 March. Ukrainian Embassy representatives were present for the hearing, but it was reported that there was no direct contact between embassy staff and the detainees, which raised concerns over access to the consulate.

According to Indian authorities, the group had breached the Restricted Area Permit (RAP) regulations. Entry into Mizoram is strictly controlled by the Government of India due to the area’s sensitive location near Myanmar and a pending border issue of over 510 km. The National Investigative Agency (NIA) of India suggests that those detained have committed the offences of unlawful association/joining ethnic armed associations in Myanmar, as well as providing equipment training (including drone training) and multiple forms of assistance to those groups.

Diplomatic Tensions

Kyiv has officially submitted a formal protest regarding the detentions through its ambassador, Dr Oleksandr Polishchuk, to the Ministry of External Affairs of India. The Ukrainian Ministry of Foreign Affairs indicated that there is no “established fact” at this time which supports the position of the group on being involved in illegal activity.

One of the main complaints is that there was no official notification from Indian authorities to the Ukrainian Embassy prior to the detention; this may constitute a breach under the Vienna Convention on Consular Relations. Ukrainian authorities have also stated that a lack of appropriate signage in restricted areas on the ground creates an increased risk for foreign visitors as a consequence of potentially committing “unintentional violations”.

Media Controversy

Intense media coverage of the case from both India and outside of India has contributed to negative public sentiment towards Ukraine, according to Ukrainian authorities. Kyiv has denied early media reports claiming that terrorist groups were involved, stating that no evidence exists to support these claims. The US Embassy has responded to information regarding Matthew VanDyke, an American citizen who was detained in Ukraine. The US Embassy has taken a cautious approach towards handling Matthew VanDyke, citing privacy protocol and declining to provide updates on the specifics of his case.

Strategic and Security Context

Due to its close proximity to Myanmar, Mizoram is a crucial area in terms of sensitivity towards India. The ongoing civil war in Myanmar, which started following the military coup of February 2021, has created a raised risk for New Delhi regarding increased violence and the potential for refugees from Myanmar. 

India’s focus on maintaining security explains why the NIA has acted decisively within the bounds of anti-terror laws. Authorities state that any foreign backing of groups located close to the border poses a threat to national security; therefore, strict enforcement is necessary.

The Way Forward

Ukrainian diplomats’ priority is on providing their citizens with “unimpeded consular access” until March 27, when the investigation will conclude. India continues to insist that its response was based on matters of national security and law compliance in regard to detentions. As a result of this situation between these two countries, analysts believe that there are diplomatic ramifications beyond the present situation due to the balancing act of maintaining national security while honouring international relations (including human rights). The ability to provide transparency and cooperate with the respective foreign missions will assist in building confidence related to the implementation of any future security measures.

Human and Diplomatic Stakes

The RAP (Removal and Administrative Penalty) detentions highlight the risk of cross-border violations with respect to the entry of foreign persons into sensitive border areas. The issue also involves issues related to human rights, consular obligations and trust between countries. Both Ukraine and India must work to resolve this issue in an appropriate manner so that there is not an increase in tensions, the rights of the people who are detained are protected, and the two countries maintain good relations.

This case may also determine how India will handle foreign access to restricted areas in the future, particularly in locations at risk of spillover from conflicts and cross-border security threats.
